Problems associated with administrative law enforcement in highway construction affecting seismic monitoring facilities and monitoring sites and strategies for their solution

  • With the fast economic development of China, more and more superhighways have been constructed, which, in turn, affect the adjacent seismic monitoring sites and the corresponding monitoring facilities. The administrative law enforcement is to ensure the integrity of the monitoring facilities and to remove the disturbing sources in the effective functioning range of these facilities, which are essential to the quality of seismic monitoring and forecast. This kind of administrative law enforcement is interdisciplinary, with a requirement of expertise in seismic monitoring, electro-magnetics, crustal movement and underground fluid observations as well as knowledge of laws and regulations on earthquake prevention and disaster reduction. Three typical legal cases occurring in Gansu Province, are introduced, with the key points in each enforcement phase analyzed. A few problems, such as lack of legal basis, inadequate initiative, low enforcement efficiency, and insufficient propagation, are discussed, and practical suggestions are proposed.
